Indiana Code, Section 34-28-5-1 (h)
Upon receipt of a summons or ticket for an infraction, you may be eligible to participate in an Infraction Deferral Program. If you are eligible and wish to complete the program, then the infraction charge will be dismissed. If you have already paid your ticket in the Clerk’s Office or missed your court date without re-scheduling, you are ineligible for this program. Participation under this program is discretionary and the Prosecutor’s Office may choose not to offer the program even if you appear to qualify.
REQUIREMENTS FOR INFRACTION DEFERRAL (Effective January 1, 2023)
1. You must agree in writing to the terms of the Infraction Deferral Program.
2. You must not have participated in an Infraction Deferral Program in Greene or any other county within two years from the date of the infraction.
3. You must agree to pay a user fee in the total amount of $206.00.
4. You must not have been operating a vehicle without a license or with a suspended license at the time of the infraction.
5. You may have no more than three previous moving violations within 10 years on your entire driving record.
6. You must have no prior felony or class A misdemeanor convictions in your criminal history.
7. If you pay child support, then you must be paying support as ordered by the Court.
8. Overweight tickets are not permitted to be deferred through the Infraction Deferral Program.
9. If your ticket cites you for exceeding the speed limit by 26 miles per hour or more, then you will not be allowed to participate in the Infraction Deferral Program.
10. Under federal law, no person who holds a commercial driver’s license is eligible to participate in this program for any moving violation.
YOU MUST BE AT LEAST 18 YEARS OF AGE TO PARTICIPATE.
SOME REQUIREMENTS ARE ELIGIBLE TO BE WAIVED AT THE PROSECUTOR’S DISCRETION.
